1. Acceptance of terms
By creating an account or using pekou (the “Service”) you agree to be bound by these Terms & Conditions and by our Privacy Policy. If you do not agree, do not use the Service. These terms may be updated from time to time; continued use after changes means you accept them.
2. Eligibility
You must be at least 18 years old and able to enter into a binding contract to use pekou. The Service is offered as an invitation-only community at the operator’s discretion; access may be granted, revoked, or limited at any time.
3. Account and security
You are responsible for safeguarding your login credentials and for any activity under your account. You agree to provide accurate information and to keep it up to date. Notify us immediately of any unauthorised use. We may suspend or remove accounts that violate these terms or that we reasonably believe to be inauthentic, fraudulent, or harmful.
4. User content
You retain ownership of the photos, descriptions, and other content you upload (“User Content”). By posting User Content you grant pekou a worldwide, non-exclusive, royalty-free licence to host, display, reproduce and distribute it solely for the purpose of operating and promoting the Service. You represent that you own the rights to anything you upload, that it does not infringe any third party, and that it is accurate.
5. Listings and transactions
pekou is a community platform. We do not own, inspect, or guarantee any vehicle listed on the Service. We are not a party to any sale or transaction between members. You are responsible for verifying the vehicle, the seller, the price, and the legal requirements of any sale in your jurisdiction. pekou accepts no liability for the accuracy of listings, the conduct of users, or the outcome of any transaction.
6. Acceptable use
You agree not to: post unlawful, misleading, defamatory, sexually explicit, harassing, or hateful content; impersonate another person; scrape, harvest, or reverse engineer the Service; interfere with its operation; or use it for spam, money laundering, or any illegal activity. We may remove content and terminate accounts at our sole discretion.
7. Fees
Basic use of pekou is free. Optional paid features, if and when offered, will be clearly priced before purchase. All fees are non-refundable except where required by law.
8. Intellectual property
pekou, the wordmark, the design and software are the property of the operator and protected by applicable laws. Nothing in these terms grants you any right to our trademarks or to the underlying code.
9. Disclaimer
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
10. Limitation of liability
To the maximum extent permitted by law, pekou and its operators will not be liable for any indirect, incidental, consequential, special or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim will not exceed one hundred euros (€100).
11. Indemnity
You agree to indemnify and hold harmless pekou and its operators from any claim, damage, loss, or expense (including reasonable legal fees) arising out of your User Content, your use of the Service, or your breach of these terms.
12. Termination
You may delete your account at any time from Settings. We may suspend or terminate your access at any time, with or without cause or notice. Sections that by their nature should survive termination will survive.
13. Governing law
These terms are governed by the laws of the operator’s country of establishment, without regard to conflict of laws principles. The courts of that jurisdiction will have exclusive jurisdiction over any dispute, subject to any non-waivable consumer rights you may have.
